O R D E R

This Criminal Original Petition has been filed seeking direction to the 3rd respondent to register the complaint given by the petitioner dated 12.09.2017.

2. The learned Additional Public Prosecutor would submit that the petitioner did not appear for enquiry. By taking the reason that H.M.O.P No.61 of 2017 is pending before the Family Court, Pattukottai, the complaint was closed.

3. The learned counsel for the petitioner has disputed the fact that the petitioner has not received any summons and therefore, an opportunity shall be granted to the petitioner to appear before the respondents for enquiry.

4. By recording the aforesaid submission made by the learned counsel for the petitioner, and as the respondents have not placed any material evidence before this Court, that the summon has been served to the petitioner. Therefore, the respondents has to serve the summons to the petitioner and conduct enquiry in accordance with law.

5.With the above observation, this Criminal Original petition is disposed of.
