For Respondent : Mr.K.Dineshbabu, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.289 of 2018 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(B), 147, 148, 149, 302 of IPC and Section 5 of Explosive Substance Act, in Crime No.289 of 2018, seeks anticipatory bail. 2.Today, when the matter came up for hearing, the learned counsel for the petitioner would submit that the anticipatory bail was given up on the ground that the final report has been filed in this case and that there is a change of circumstances, the petitioner is entitled for grant of anticipatory bail to him. 3.A perusal of the order in Crl.O.P.(MD)No.14155 of 2020 dated 07.12.2020 shows that this petitioner herein is arrayed as A-1 and he is the master brain behind the entire crime and he is not in India and he escaped to Malaysia, where he is doing hotel business. Therefore, a specific direction was issued to the respondent police https://hcservices.ecourts.gov.in/hcservices/
to take steps to secure the petitioner and proceed in accordance with law. In this case, the final report has already been filed before the concerned Court.
4.Considering the facts and circumstances of the case and also considering the fact that a specific direction was given by this Court to secure the petitioner and proceed in accordance with law, this Court is not inclined to anticipatory bail to the petitioner. 5.Accordingly, the Criminal Original Petition stands dismissed. sd/- 22.04.2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
