O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to consider the petitioner's representations dated 10.05.2024 and 15.09.2025 and consequently issue patta in respect of the petitioner's agricultural land measuring an extent of Page No. 2 of 7

1 Acre and 80 cents in Ayan Punjai S.No. 145/2, situated at Pattakurichi Village, Tenkasi Taluk, Tenkasi District, under Section 37-A of the Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961, in terms of G.O.(Ms.) No. 596, Revenue and Disaster Management Department, Land Reforms Wing, LR.2(2) Section, dated 24.10.2020, within a time frame to be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that his father, namely M.Thiagarajan, during his lifetime, purchased several properties including the subject property. He installed a windmill in the subject property for generation of electricity and sold the power generated to TANGEDCO, for which a Commissioning Certificate was issued by the Superintending Engineer, Tirunelveli Electricity Distribution Circle, Tirunelveli - 11.

4. The petitioner's father executed a Will in favour of the petitioner, wherein the subject property is described at Sl. No. 11. After the demise of the petitioner's father, TANGEDCO issued a Name Transfer-cumPage No. 3 of 7

Migration approval from Sale to Board (EPA) under the REC Scheme to Third Party Users (EWA) under the non-REC Scheme, vide proceedings dated 10.04.2023, in the name of the petitioner.

During his lifetime, the petitioner's father had applied for issuance of patta in respect of the subject property, which came to be rejected on the ground "Surplus declaration in process under the Land Reforms Act". Therefore, he submitted a representation under Section 37A of the Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961. However, no action was taken thereon.

Subsequently, the Government of Tamil Nadu issued G.O.(Ms.) No. 596, Revenue and Disaster Management Department, Land Reforms Wing, LR.2(2) Section, dated 24.10.2020, permitting industries and commercial undertakings to hold lands. Thereafter, the petitioner submitted representations dated 10.05.2024 and 15.09.2025 to the respondents seeking issuance of patta. However, no action has been taken till date. Hence, the petitioner has been constrained to file the present Writ Petition.

7. The learned Government Advocate appearing for the respondents, on instructions, would submit that the petitioner's representations dated 10.05.2024 and 15.09.2025 would be considered and appropriate orders would be passed by the second respondent within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representations dated 10.05.2024 and 15.09.2025 and pass appropriate orders on its merits and in accordance with law within a period of sixteen

(16) weeks from the date of receipt of a copy of this order. The second respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order. There shall be no order as to costs.
