Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the second respondent, Chief Executive Officer, Tamil Nadu Khadi and Village Industries Board to consider and pass orders on the representation submitted by the petitioner on 10.11.2017 together with the reminders dated 03.01.2018, 10.04.2018, 08.08.2018, 26.11.2018 and 07.01.2019 requesting to fill up the remaining 15 posts of Junior Assistants out of 39 posts by way of promotion, which was already sanctioned by the State Government and promote the petitioner as Junior Assistant.

ORDER

This Writ Petition has been filed seeking for a direction to the second respondent, to consider and pass orders on the petitioner's representations and to promote him as Junior Assistant.

2.According to the petitioner, though the Government has accorded permission to fill up 39 Junior Assistant Posts, by way of promotion, the respondents have filled up only 24 posts and the remaining 15 posts are kept vacant, when enough number of eligible candidates, including the petitioner, are there. In this connection, from 10.11.2017 to 07.01.2019, the petitioner sent representations, which have not seen any light thus far. Praying for necessary orders, the petitioner is before this Court.

3.The learned Special Government Pleader appearing for the respondents, on instructions, submitted that the grievance of the petitioner would be addressed on merits.

4.Under such facts and circumstances, this Court, without going into the merits of the case, directs the 2nd respondent to consider the petitioner's representations submitted on various dates, on merits and in accordance with law and pass appropriate orders, after affording opportunity of hearing to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.
