ORDER

This Criminal Original Petition has been filed to direct the learned Special Court for the Exclusive Trial of SC and ST Cases, Ramanathapuram, to consider the bail application of the petitioners in connection with the FIR in Crime No. 12 of 2026 on the file of the second respondent.

2. Considering the nature of the relief sought for, notice to the third respondent is dispensed with.

3. Gist of the case: The third respondent has given a complaint as against the petitioners herein. The third respondent belongs to Schedule Caste and on 08.02.2026, when the defacto complainant and his relatives 2/6

went to Angala Parameswari temple, due to some parking issue, the accused persons abused the defacto complainant in order to denigrate his community and attacked him and his relatives with wooden log. In the incident, the defacto complainant has lost his 2 sovereigns of gold chain. Hence the complaint in Crime No.12 of 2026 has been registered for the offences under Sections 189(2), 296(b), 115(2) of BNS, 2023 and under Section 3(1)(r) & 3(1)(s) of the scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. Considering the limited scope of the relief sought for, this Court hereby directs the learned Special Court for the Exclusive Trial of SC and ST Cases, Ramanathapuram, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.12 of 2026 on the file of the second respondent police. The petitioner shall surrender before the learned Trial 3/6

Court within a period of 15 days from the date of receipt of a copy of this order.
