ORDER

This Criminal Original Petition has been filed for issuing a direction to the respondent Nos. 1 to 3 not to harass the petitioner under the guise of enquiry.

The learned Public Prosecutor appearing for the respondents police would submit that on the basis of the complaint given by the 4th respondent in C.No.191 / PG / Camp / DCP South / MC / 2023 and C.No.57/AC TDN / DC Camp / MC / 2023 the petitioner was called for enquiry and during the course of enquiry, it was found that the 4th respondent was a subscriber to the chit which was conducted by the petitioner. But, later, because of default threat was made by the petitioner over which the complaint has been given by the 4th respondent raising some sort of allegations that the petitioner is demanding exorbitant interest.

3. The learned counsel appearing for the petitioner submitted that the cheque issued by the 4th respondent for repayment of the loan amount was dis honoured.

4. In view of the specific complaint, the petitioner shall appear before the respondent police and co-operate with an enquiry with regard to the allegation of demand of exorbitant interest. During the course of enquiry, if any trouble arises, the petitioner shall work out his remedy through appropriate proceedings.

5. With the above direction, this Criminal Original Petition is disposed of.
