PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India, to set aside the Fair and Decreetal order dated 20.11.2025 passed in I.A.No.01 of 2024 in R.C.O.P.No.120 of 2016 on the file of the 1st Additional District Munsif Court, Tiruchirappalli by allowing the Civil Revision Petition and pass such further or other orders as this Honourable Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

The order passed by the I Additional District Munsif Court, Tiruchirapalli in I.A.No.1 of 2024 in R.C.O.P.No.120 of 2016 dated 20.11.2025 is appealable before the Rent Control Appellate Authority under Section 23 of the TamilNadu Buildings Lease and Rent Control Act, 1960. When appeal is tenable, revision under Section 25 or under Section 115 of Code of Civil Procedure cannot be maintained.

2. When this aspect is pointed out, learned Counsel for the petitioner seeks permission to withdraw the present revision with liberty to move appeal before the Rent Control Appellate Authority.

3. Liberty is granted.

4. The present Civil Revision Petition is dismissed as withdrawn.No costs. Consequently, connected miscellaneous petition is closed. 16.03.2026 gvn 2/4
