ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1, A4 and A5 apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 384, 420, 465, 468 and 471 I.P.C in Crime No.68 of 2015 on the file of the respondent police and hence, seek anticipatory bail. 2.The case of the prosecution is that the accused have collected excess toll fee at Bomban bridge by fabricating documents. 3.The learned counsel for the petitioners submitted that the first petitioner is a licensee and the other petitioners are collecting agents. The learned counsel filed an affidavit of undertaking dated 09.06.2015 stating that they will not collect more than the toll fee fixed by the Government from the travellers.
4,The learned Government Advocate(Crl.side) submitted that the petitioners are having one previous case each and they have collected higher amount than the amount fixed by the Government from the travellers.
5. Considering the submissions made by the learned counsel for the petitioners and the affidavit of undertaking, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions.
6. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Rameswaram, Ramanathapuram District, on each of them executing a separate bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily twice at 10.00 a.m and 5.00 p.m until further orders.
