O R D E R

This writ petition has been filed for issuance of a Writ of Mandamus directing the second respondent to grant permission and protection for conducting cultural event namely Aadalpadal scheduled to be held on 28.04.2018 at night in connection with "Chithirai Festival" Arulmigu Sri Kaliamman Temple at Main Road, Lakshmi Puram, Periyakulam Taluk, Theni district by considering the petitioner's representation dated 03.04.2018.

2.Heard the learned senior counsel appearing for the petitioner and the learned Government Advocate(Crl.side) appearing for the respondents.

3.According to the learned counsel appearing for the petitioner, the petitioner made a representation dated 03.04.2018 to the second respondent to grant permission and protection for conducting cultural event namely Aadalpadal scheduled to be held on 28.04.2018 at night in connection with "Chithirai Festival" Arulmigu Sri Kaliamman Temple at Main Road, Lakshmi Puram, Periyakulam Taluk, Theni District. Since no order is passed, the petitioner is before this Court.

4. According to the learned counsel for the petitioner, the representation was given by the petitioner as the member of the Vizha Committee.

5. The learned Government Advocate would submit that the petitioner has not mentioned that he is the member of the Vizha Committee in his representation and he has only mentioned in the affidavit.

6. This Court has carefully considered the rival submissions made by both sides and perused the materials placed on record.

7. The learned Government Advocate(Crl.side) submitted that the petitioner has not mentioned that he is the member of the Vizha Committee in the representation. Per contra, the learned counsel for the petitioner submitted that the representation was given by him as the member of the Vizha Committee.

8. In the light of the rival submissions, the petitioner is directed to give a fresh representation to the second respondent mentioning that he is the member of Vizha Committee. On receipt of the said representation, the second respondent police shall consider the same on merits and in accordance with and pass an appropriate orders on or before 26.04.2018.

9. With the above direction, this writ petition is disposed of. No costs.
