ORDER
This petition is filed to relax the condition imposed on the petitioner, by this Court in Crl.M.P.(MD)No.12826 of 2024 in Crl.A.(MD)No.1037 of 2024, by order dated 29.11.2024.
2. This Court, while suspending the sentence on 29.11.2024, directed the petitioner to appear before the learned II Additional District and Sessions Judge, Tiruchirappalli, daily at 10.30 a.m. till the disposal of the appeal.
3. The learned counsel appearing for the petitioner submits that the petitioner is regularly complying with the condition from 04.01.2025 onwards. He further submits that the petitioner is aged about 66 years and she is suffering with old age ailments. Further, she has to travel from her home to trial Court for nearly 120 kms. daily. Therefore, she seeks for relaxation of the said condition.
4. The learned Government Advocate (Crl. Side) has also confirmed that the petitioner is regularly complying with the condition from 04.01.2025 onwards.
5. Considering the fact that the petitioner is complying with the condition from 04.01.2025 onwards, this Court is inclined to modify the condition imposed in Crl.M.P.(MD)No.12826 of 2024.
6. Accordingly, this Criminal Miscellaneous Petition is allowed and the condition is modified to the effect that the petitioner shall appear before the trial 2/3
