O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to third respondents to conduct a survey and fix the boundaries of the properties comprised in the following Survey Numbers:
1. S.No.646/4 measuring an extent of 0.46 Hectares;
2. S.No.646/5 measuring an extent of 0.43 Hectares;
3. S.No.646/7 measuring an extent of 0.37 Hectares;
4. S.No.646/8 measuring an extent of 0.32 Hectares; totalling an extent of 1.58.0 Hectares, situated at Vanniconendal, Tirunelveli District, in pursuance of Petition No.2025/0123/29/005579 dated 25.08.2025 submitted by the petitioner and to complete the said survey within such time as may be fixed by this Court. 2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner would submit that an online application has been made for the survey of the properties in question and for demarcation of boundaries.
4. The learned Special Government Pleader appearing for the first to third respondents, on instructions, would submit that after consideration of the claims of the parties, proper steps would be taken to survey and demarcate the properties in question in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.
5. Recording the aforesaid submissions, this Court directs the third respondent to consider the online application of the petitioner dated 25.08.2025, survey and demarcate the petitioner's properties after consideration of the claims of all parties including the fourth respondent and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve (12) weeks from the date of receipt of a copy of this order. In the event of any Page No. 3 of 5
rival claims, the parties are at liberty to pursue their remedies before the Civil Court. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners, the fourth respondent and other interested parties.
6. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
