ORDER

Seeking to direct the respondents to take appropriate action by considering the petitioner's representation, dated 06.02.2026, this writ petition is filed.

2. The learned counsel for the petitioner submitted that the petitioner had given a representation dated 06.02.2026 to the respondent authorities seeking action against the persons who had posted wall posters abusing Central Government. However, the said representation has not been considered and has been kept in abeyance. Hence, this writ petition.

3. The learned Additional Public Prosecutor submitted that the representation is something which cannot be considered at all.

4. Heard the learned counsels on either side and carefully perused the materials available on record.

5. It is needless to point out that whenever a representation of this 2/5

nature is made to a Statutory Authority, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other instead of keeping the same pending indefinitely. As such, non-consideration of the representation made by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking the extraordinary powers under Article 226 of the Constitution of India.

6. It is made clear that without going into the merits of this case, the respondents are directed to consider the representation of the petitioner dated 06.02.2026 and pass appropriate orders within a period of two (2) weeks from the date of receipt of a copy of this order. No costs.

7. With the above directions, this Writ Petition stands disposed of. 04.03.2026 NCC : Yes / No Index : Yes / No Internet : Yes/ No 3/5
