RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed in Crl.O.P.(MD)No.591 of 2023 dated 10.01.2023 and to allow the petitioners to execute bond with common sureties instead of executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.RAMESH RAJA P.T., Advocate for the petitioner and of Mr.R.M.ANBUNITHI, Additional Public Prosecutor(crl.side) on behalf of the Respondent, the Court made the following order:- This Criminal Miscellaneous Petition has been filed to modify the condition imposed in Crl.O.P(MD).No.591 of 2023, dated 10.01.2023.
2. The learned counsel appearing for the petitioners would submit that petitioners were granted anticipatory bail by this Court on 10.01.2023. Since they were unable to arrange 38 sureties, they could not comply with the conditions. Hence, he prays to execute bond with common sureties instead of executing a bond for a sum of Rs.10,000/-.
3. Heard the learned Additional Public Prosecutor appearing for the respondent.
4.Taking into consideration the facts and circumstances of the case and also the submission made by the learned counsel for the petitions the condition is modified to the effect that the petitioners to execute bond with common sureties instead of executing a bond for a sum of Rs.10.000/- (Rupees Ten Thousand only) each with two sureties. The other conditions shall remain unaltered.
