O R D E R

Challenging the order dismissing the petitioner's private complaint under Section 203 Cr.P.C, the present criminal revision case has been filed.

2.The petitioner filed a private complaint against the respondents on the ground that the respondents have stolen one unit of sand worth of Rs.30,000/-. On receipt of the complaint, the learned Judicial Magistrate, Thirumangalam ordered an enquiry under Section 202 Cr.P.C and directed the Sindhupatti Police to enquire in this regard file a report. The Sub-Inspector of Police, Sindhupatti Police Station filed a report stating that on the basis of the complaint given by the first respondent, the petitioner was already arrested and there is a civil dispute between the parties. The learned Judicial Magistrate, after considering the complaint, statements of the witnesses and based on the enquiry report, dismissed the private complaint filed by the petitioner stating that no prima facie case has been made out.

3. I have heard Mr.R.Murugappan, the learned counsel appearing for the petitioner and Mr.S.Sendurapandian, the learned Counsel appearing for the respondents and perused the records carefully.

4.On perusing the order, I find no illegality or irregularity in the order passed by the learned Judicial Magistrate, Thirumangalam. Hence, this criminal revision case is dismissed.
