Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1 apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 279, 337, 338, 304 and 304(A) of I.P.C., in Crime No.69 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2. The prosecution case is that on 02.05.2015, the first accused drove a bus belonging to the Tamil Nadu State Transport Corporation, in a rash and negligent manner and caused death of 5 persons and caused injuries in 33 persons.

3. The learned counsel for the petitioner submitted that the second accused had covered the entire road by depositing millets and he is responsible for the accident. It is further submitted that the driver of the van, who was proceeding in the opposite direction caused the accident and the petitioner is innocent.

4. The learned Government Advocate (Crl.side) vehemently opposed the anticipatory bail petition stating that in this case, https://hcservices.ecourts.gov.in/hcservices/ 5 persons died and 33 persons sustained injury.

5. Considering the gravity of the offences, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
