Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Mandamus, directing the respondents to grant permission and to provide Police protection to conduct Devotional / Antique Drama namely Sri Valli Thiurmanam as a part of Madhu Eduppu Festival in Arulmighu Sri Muthu Mariamman Temple, Kailasapuram on 21.03.2021 and 23.03.2021 at about 10.00 p.m. to 6.00 a.m. respectively.

By consent, this Writ Petition is taken for final hearing.

On the side of the petitioner, it is stated that the petitioner has filed a petition before the police and the election officials for granting permission to conduct Valli Thirumanam Drama at the Temple festival of Sri Konnaiyur Muthu Mariyamman Temple, Konnaiyur Village, Ponnamaravathi Taluk. In this regard, the petitioner submitted a representation dated 17.03.2021, but, the respondents orally rejected permission. It is further stated that in the similar circumstances, this Court has ordered and passed similar order in W.P.(MD)No.7380 of 2019 , dated 28.03.2019 and in W.P.(MD)No.5511 of 2021, dated 12.03.2021.

WP(MD)No.6378 of 2021 3.On the side of the respondents, it is stated that the order cited was passed when there was no declaration of election and when there was no COVID-19 pandemic situation.

4.On hearing both sides, this Court directs the petitioner to approach the respondents once again. The respondents are at liberty to decide the issue afresh in accordance with the situation prevailing in the said locality.

5.With the above directions, the Writ Petition is closed. No costs.
