ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 427, 448 and 506(i) of I.P.C, and Section 4 of Tamil Nadu Prohibition of Charging Exorbitant Interest Act, 2003, in Crime No.598 of 2017, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant borrowed a sum of Rs.28,00,000/- from the petitioners, in the year 2016, the petitioners demanded the said amount with Exorbitant Interest. Aggrieved by the same, the defacto complainant filed a complaint before the respondent police under Exorbitant Interest Act.

3.The learned counsel for the petitioner submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution.

4. The learned Government Advocate (Crl.side) appearing for the State submits that the case was referred as "Mistake of Fact" Hence, the question of granting anticipatory bail to the petitioners does not arise.

5.Considering the facts and circumstances of the case and considering the said submission made by the learned Government Advocate (Crl.Side), the question of granting anticipatory bail to the petitioners does not arise. Accordingly, this petition is closed.
