Pleased to set aside the judgment and decree dated 25.10.2018 in MCOP No.1030 of 2016 on the file of the Motor Accident Claims Trubunal, Special Sub Court, Madurai.

ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.SARANGAN, Additional Government Pleader for the petitioner and of Mr.K.KUMARAVEL, Advocate on behalf of the Respondent, the Court made the following order:- This Court by order dated 30.03.2021, in C.M.P(MD)No.2948 of 2021, granted interim stay on condition that the appellant should deposit the entire award amount with accrued interest and costs to the credit of M.C.O.P.No.1030 of 2016 on the file of the Motor Accident Claims Tribunal, Special Sub Judge, Madurai, within a period of eight weeks from the date of receipt of a copy of the order, failing which, the interim order granted shall stand vacated automatically without any further reference to this Court. CMP(MD) No.2948 of 2021 petitioner did not comply with the same however, on 17.12.2021 the learned Additional Government Pleader appearing for the petitioner sought time and this Court also granted further period of one month time for depositing the amount. But even then the petitioner did not deposited the said amount. Hence, the Civil Miscellaneous Petition stands dismissed.
