Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 31.01.2026 to issue Death Certificate for the petitioner's mother-in-law Packiyam, wife of Pitchai, who died on 16.01.1988 in accordance with law and under Rule 9(3) of the Tamil Nadu Registration of Births and Deaths Rules, 2000 within time frame fixed by this Court.

ORDER

This Writ Petition has been filed seeking a direction to the respondents to consider the petitioner's representation dated 31.01.2026 for issuance of a Death Certificate in respect of the petitioner's motherin-law, Packiyam, wife of Pitchai, who died on 16.01.1988, in accordance with law and under Rule 9(3) of the Tamil Nadu Registration of Births and Deaths Rules, 2000, within a time frame to be fixed by this Court.

2. Mr.K.Balasubramani, learned Special Government Pleader takes notice for respondent Nos.1, 3 and 5 and Mrs.S.Devasana, learned counsel takes notice for respondent Nos.2 and 4. By consent of both 2/6

parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. According to the petitioner, his mother-in-law passed away on 16.01.1988. The petitioner approached respondent Nos.2 and 4 for issuance of a Death Certificate. Hence, the petitioner submitted a detailed representation to the respondents on 31.01.2026 seeking for issuance of the Death Certificate of his mother-in-law. However, no action has been taken on the said representation till date. Hence, the present Writ Petition.

The learned counsel appearing for respondent Nos.2 and 4 submitted that unless the petitioner provides the correct particulars of his mother-in-law, particularly with regard to the date and time of death and the place of death, the respondents are not in a position to issue the Death Certificate. She further submitted that if the petitioner furnishes the correct particulars, the respondents are ready to issue the Death Certificate.

In such view of the matter, this Court directs the petitioner to submit a fresh representation by providing all necessary details, including the time of death and address, to the concerned respondent. On receipt of such representation, the concerned respondent shall consider the same and issue the Death Certificate, if the petitioner is otherwise entitled, within a period of eight weeks from the date of receipt of the representation.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
