ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the second respondent to implement the proceedings of the first respondent in Ni.Mu.A5/4926/2024 dated 08.01.2025, in a proper manner and within the time limit stipulated by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner submits that the subject property was bequeathed to the petitioner's husband under a registered Will vide Document No.8 of 2007. Suppressing the said Will, the petitioner's sister-in-law created false and forged documents and executed a settlement deed in favour of the petitioner's sister-in-law's husband, who in turn, again executed a sale deed in favour of the petitioner's sister-in-law. Aggrieved over the same, the petitioner's husband filed a complaint before the first respondent and upon detailed enquiry, the first respondent found that the certificate relied upon was forged and never issued by the second respondent and directed the second respondent to cancel the

Patta stands in the name of the petitioner's sister-in-law and restore the Patta in the name of the petitioner's husband's paternal uncle A.Daniel. Subsequently, the petitioner's husband died on 18.10.2023. However, no progress has been made thereafter. Hence, the petitioner has filed the present Writ Petition.

4. The learned Special Government Pleader appearing for the respondents submits that the second respondent requires twelve weeks' time to pass appropriate orders in accordance with law.

5. Recording the above submissions, this Writ Petition is disposed of, with a direction to the second respondent to pass appropriate orders in accordance with law, after giving due opportunity to the petitioner and all other persons, who may be interested in the subject matter, within a period of twelve weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the second respondent to consider the same on its own merits. There shall be no order as to costs.
