O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the third and fourth respondents to reclassify the land in Survey No.43/1C1A by removing its classification as Government Surplus Land and reclassifying it as Patta Land and consequently to issue patta for the land measuring an extent of 8 acres and 3 cents in Survey No. 43/1C1A at Koonthankulam Village, Nanguneri Taluk, Tirunelveli District, by considering the petitioner's representation dated 30.01.2026.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that the subject property originally belongs to one Pemial Vimalabhai, who executed a General Page No. 2 of 6

Power of Attorney dated 23.01.2025 in favour of the petitioner in respect of the subject property as well as certain other properties. The petitioner has already sold the other properties. When the petitioner was about to sell the subject property, he came to know that the said land had been wrongly classified as Surplus Land (Poramboke) and that such classification was reflected in the 'A' Register. Therefore, the petitioner submitted a detailed representation dated 30.01.2026 to the respondents seeking reclassification of the land and issuance of patta. However, no action has been taken thereon. Hence, the petitioner has been constrained to file the present Writ Petition.

4. The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that the petitioner's representation dated 30.01.2026 would be considered and appropriate orders would be passed by the third respondent within a period of six months.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representation Page No. 3 of 6

dated 30.01.2026 and pass appropriate orders on its merits and in accordance with law within a period of six (6) months from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The third respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order.
