ORDER : The Court Made the following order :- The petitioner, who is arrayed as A3 in Crime No.331 of 2014 on the file of the respondent police apprehends arrest in pursuance of the Non Bailable Warrant issued by the learned Judicial Magistrate, Cheranmahadevi in P.R.C.No.13 of 2014 for the alleged offences punishable under Sections 302 IPC r/w 120 IPC r/w 3 (2) (x) SC/ST Act and hence, seeks anticipatory bail.
2.The learned counsel for the petitioner submitted that the petitioner was granted anticipatory bail and he was regularly appearing before the Court and due to unavoidable circumstances, he could not appear before the learned Judicial Magistrate on 17.02.2015 and hence, NBW was issued. He would further submit that the petitioner would attend for all further hearings without fail.
3.The learned Government Advocate (Criminal Side) appearing for the respondent submitted that except the petitioner, the other accused have been appearing before the committal Court and Non Bailable Warrant was issued due to his absence.
4.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.
5. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Cheranmahadevi, Tirunelveli District and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Court concerned and on further condition that the petitioner shall appear before the concerned Court in all future hearings without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6.
