O R D E R
This Criminal Original Petition has been filed seeking a direction to the third respondent to register a case based on the petitioner's complaint, dated 08.11.2017 and to investigate the matter and proceed in accordance with law.
2.According to the petitioner, he made a complaint to the third respondent to take action against the proposed accused viz., Manickam alleging that he received a threat to his life and limb. Since no action has been taken on his complaint, he filed the present Criminal Original Petition.
3.The learned Government Advocate (Criminal side) has produced a copy of the status report filed by the third respondent before this Court and submitted that through the Intelligence Section of Madurai City, it is learnt that there is a life threat persists to the petitioner viz., Seetharaman by one Manickam, for https://hcservices.ecourts.gov.in/hcservices/
non-payment of brokerage commission to him. Further, the said Manickam was called to the Police Station and an undertaking was obtained from him by getting an assurance that he will not indulge in any illegal activities. It is further learnt that the broker Manickam has not gone to the petitioner's residence or to his Office. He did not involve in any criminal activities in order to eliminate the petitioner's life and only an official memo has been received from the Intelligence Section carrying an alert message that the petitioner's life is in danger, because of the non-payment of brokerage commission to the said Manickam. After receiving the message, the same was conveyed to the petitioner and preventive measures have been taken to safeguard the petitioner's life. The investigation reveals that there is no threatening to the petitioner either from the broker Manickam or from his Associates. The suspected movements have been monitored and restricted regularly by checking the Patrol Book. Therefore, recording the above, this Criminal Original Petition may be closed.
4.Hence, recording the above said submission made by the learned Government Advocate (Criminal side), this Criminal Original Petition is closed.
