ORDER
This petition has been filed to direct the respondents 1 to 3 to provide adequate police protection to the life and limb of the petitioner from the hands of the 4th & 5th respondents and direct the respondent police to take appropriate legal action on the basis of the petitioner's representation, dated 11.02.2026.
2. The learned counsel for the petitioner categorically contended that her life and limb is endangered by the 4th and 5th respondents, who are none other than the petitioner's parents. She has suffered untold domestic abuse in the hands of her husband and her parents and in this regard, she has run away from the matrimonial home. However, her parents supporting her husband and are continuously torturing her. She has approached the third respondent police, who have turned a deaf ear for her plate without affording necessary police protection.

The learned Government Advocate (Crl.Side) submitted that the petitioner had eloped with another woman's husband named Kamalakannan deserting her minor female child and her husband, the said Kamalakandan with whom she had eloped is also a father of two minor children amd he had also deserted his family and had run away with this petitioner. The petitioner's address in this affidavit itself is a fake address and the same has been duly enquired and investigated by the 3rd respondent police. No harassment is faced by the petitioner at the hands of the 4th and 5th respondents. In fact, she had filed this petition only at the instance of that Kamala Kannan with whom she had eloped. The learned Government Advocate (Crl.Side) also drew my attention that the man with whom she had run away is her distant brother.
4. Heard the learned counsels on either side and carefully perused the materials available on record.
5. Considering the critical nature of the family dispute involved in this petition, notice to the 4th and 5th respondents are dispensed with. 3/6
6.It is the primordial duty of a mother to take care of a minor child, irrespective of whatever hurdles or hindrances or difficulties she face in her life.In the instant case, having begotten the minor child, the petitioner has run away and has sought the indulgence of this Court to afford police protection. This Court promptly directs the petitioner to take care of the well-being of the child and warns her strictly not to file frivolous petitions like this.

Accordingly, this Criminal Original Petition is dismissed and the petitioner is imposed with a hefty cost of Rs.50,000/- for establishing an E-Library to the credit of the MBHAA, in Indian Bank, Madurai Bench of Madras High Court Branch, Account No.496038755 IFSC No.IDIB000H040, MICR Code: 625019020 on or before 16.04.2026, for wasting the time of this Court in the name of filing of this petition under Section 528 BNSS, 2023.
8. The petitioner is directed to file a memo along with the photocopy of the receipt before the Registry on or before 16.02.2026. List the matter on 17.04.2026, for reporting compliance.

9. The learned counsel for the petitioner sought permission of this Court to withdraw this petition. However, this Court is inclined to permit the petitioner to withdraw this petition on additional cost of Rs.50,000/- within two days from today.
