ORDER

This Criminal Original Petition has been filed seeking orders to transfer the investigation of the case in Crime No.21 of 2024, dated 10.02.2024 from the file of the second respondent and transfer the same to any other competent investigating officer or agency based on the petitioner's representation dated 27.02.2024.

2.The learned counsel appearing for the petitioner submitted that the petitioner is the defacto complainant, who had given complaint before the second respondent, for which, FIR came to be registered in Crime No.21 of 2024, dated 10.02.2024, for the offences under Section 174 of Cr.P.C., with respect to the suspicious death of her daughter, Chinnathangam. However, there is no progress in the investigation. Hence, she filed the present petition.

3. The learned Government Advocate (Criminal Side) appearing for the State submitted the investigation has since been completed and consequently, the respondent police altered the offence under Section 306 IPC and secured the accused, namely Balu.

4.The learned counsel for the petitioner further submitted that apart from Balu/accused, four other persons are also responsible for the death of her daughter.

5.Heard the learned counsel for the petitioner and Mr.Thanga Aravindh, learned Government Advocate (Criminal Side) appearing for the State.

In view of the submission made by learned counsel on either side, the second respondent police is directed to file charge sheet before the jurisdictional Court (Judicial Magistrate, Manapparai) and on filing the said charge sheet, the Judicial Magistrate, Manapparai, is directed to take the same on file.

5. With the above direction, this Criminal Original Petition is disposed of. The petitioner is at liberty to file an application before the learned Judicial Magistrate, Manapparai, seeking further investigation. 30.01.2026 das 3/5
