This writ petition has been filed seeking direction to the respondents to grant permission to celebrate "Chithirai Festival" at Arulmigu Shri Perumal Swamy & Periapiratti Amman Temple, Melaramasamiyapuram, Nanagaimozhi Village, Thiruchendur Taluk, Tuticorin District dated 30.04.2018 and 01.05.2018 based on the petitioner's application dated 14.04.2018.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
3.According to the petitioner, he made a representation dated 14.04.2018 to the respondents to grant permission and protection for celebrating "Chithirai Festival" at Arulmigu Shri Perumal Swamy & Periapiratti Amman Temple, Melaramasamiyapuram, Nanagaimozhi Village, Thiruchendur Taluk, Tuticorin District dated 30.04.2018 and 01.05.2018. As no order has been passed in the said representation, https://hcservices.ecourts.gov.in/hcservices/
the petitioner has filed this writ petition with the aforesaid prayer.
4.The learned Additional Government Pleader appearing for the respondents submitted that the petitioner's representation is still pending with the second respondent. Therefore, this Court may pass appropriate orders to consider the petitioner's representation on merits and in accordance with law, subject to the law and order situation.
5.Considering the submission made by both parties, without going into the merits of the case, this Court directs the second respondent to consider the petitioner's representation dated 14.04.2018 and pass appropriate orders on merits and in accordance with law on or before 27.04.2018. The petitioner shall enclose a copy of a representation dated 14.04.2018 along with a copy of this order to the second respondent. It is made clear that while passing orders on the representation of the petitioner, it is open to the second respondent to take into consideration the law and order situation in the area in question.
6.This writ petition is disposed of, with the above direction. No costs.
