ORDER

This Criminal Original Petition is filed seeking to direct the 3rd respondent to give adequate police protection for the life and limb of petitioner and her family members from hands of the private respondents on the basis of the petitioner's representation dated 10.12.2025.

2. Since no adverse order is passed against the respondents 4 to 8, notice to the respondents 4 to 8 is dispensed with.

3. The learned counsel for the petitioner submitted that the petitioner is subjected to grave harassment by the 4th to 8th respondents 2/6

with respect to a property dispute, relating to a property which is situated in Survey No.8/4A1A to an extent of 15 cents at Seenamangalam Village which was purchased by the petitioner vide registered sale deed in Document No.1347 of 2025, dated 10.09.2025. However, the private respondents without any right or authority are unnecessarily interfering with the peaceful possession and enjoyment of the same. In this regard, the petitioner has already given a representation to the 3rd respondent police on 10.12.2025. However, the 3rd respondent police is turning a deaf ear towards the petitioner's plight and hence, this petition.

4. The learned Government Advocate(Crl.Side) submitted that the said property is not a sole property of the petitioner, but the same is comprised in a join Patta along with the private respondents. It is pointed out by the learned Government Advocate(Crl.Side) that the petitioner enjoys said property only by adverse possession, otherwise she do not have any right over the same.

5. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the civil nature of the dispute involved, the petitioner is directed to produce all the necessary title documents with respect to the subject property in Survey No.8/4A1A at Seenamangalam Village before the 3rd respondent police. The 3rd respondent police is further directed to put the respondents 4 to 8 on notice under Section 64 BNSS requiring them to produce the necessary documents under which they claim title over the said property. After conducting proper enquiry, if the petitioner's plight is found to be true, the 3rd respondent police is directed to afford necessary police protection to the petitioner on payment of necessary charges in terms of G.O(Ms)No.139, Home (PolVIII) Department, dated 04.03.2019.

7. With the above directions, this Criminal Original Petition stands disposed of.
