Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused, apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) read with 20(b)(ii)(B) of NDPS Act, in Crime No.198 of 2016, on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that on 13.07.2016, at about 04.00 a.m., the respondent police intercepted the petitioner's two wheeler and the police party found that the petitioner illegally transported 1.250 Kgs of ganja and the petitioner ran away from the place of occurrence. On complaint, a case has been registered for the above said offences.
3.The case of the petitioner is that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. A false case has been foisted against him. 4.The learned Government Advocate (Criminal side) submitted that the petitioner illegally transported 1.250 Kgs of ganja in his two wheeler and he is absconding and if he is released on anticipatory bail, he would indulge in similar offence. https://hcservices.ecourts.gov.in/hcservices/ 5.Considering the facts and circumstances of the case and also considering the serious nature of offence, this Court is not
inclined to grant anticipatory bail to the petitioner and accordingly this petition is dismissed.
