Respondent PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to pay the petitioner the amount payable as encashment of 14 days of earned leave surrendered by him in the years before his retirement based on the monthly wages payable to him on the month of his retirement together with 18% interest per annum within a time frame as may be fixed by this Court.

ORDER

Seeking encashment of earned leave salary for 14 days, the petitioner made a representation dated 22.11.2018 to the respondent. As the same has not been considered, the petitioner is before this Court.

2.According to the learned Standing Counsel appearing for the respondent, the petitioner's representation has not contained the particulars of actual period/year, in respect of which, the claim was made.

3.In such view of the matter, the petitioner is at liberty to submit a fresh representation along with a copy of this order to the respondent, enclosing the entire particulars within a period of two weeks from the date of receipt of a copy of this order. On such filing, the same shall be considered by the respondent and appropriate orders be passed thereon on merits and in accordance with law within a period of four weeks thereafter. While passing orders, the order passed by this Court in W.P(MD)No.18191 of 2018 dated 17.09.2018 shall be taken in to consideration by the respondent.
