PRAYER:- For Bail in Crime No.55 of 2023 on the file of the respondent herein. ORDER:- The Court made the following order:- The petitioner is Accused No.2, who was arrested and remanded to judicial custody on 12.02.2023, for the offences punishable under Section 8(C), 20(B)(ii), 22(C) 1/3

of NDPS Act, in Crime No.55 of 2023, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on receiving secret information, the defacto complainant went to the place of occurrence. The petitioner and the first accused stood near Om Sakthi Temple, Anathagiri 3rd street. When they tried to escape from the place, the respondent police caught them and recovered a carry bag and on the basis of the confession, they recovered 1 kg and 50 grams of Ganja and 100 grams of Magic Mashroom. Hence the complaint.

3. Learned Additional Public Prosecutor submitted that final report was filed before the II Additional NDPS Court, Madurai. He further submitted that the earlier petition filed by the petitioner for bail, was dismissed by this Court.

4. In the above circumstances, the petitioner is at liberty to approach the concerned Court for bail instead of filing repeated petitions before this Court. The trial Court may consider the petitioner's bail petition, without being influenced by the order passed by this Court in the earlier occasion.
