Respondent PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order dated 02.08.2018 passed by the respondent in letter Ref No.FCL/307462549/18 and consequently direct the respondent to issue passport by considering the clarification dated 11.07.2016.

ORDER

When the matter was taken up for hearing, the learned Additional Solicitor General appearing for the respondent submitted that the writ petitioner can very well approach the respondent and place all the relevant materials indicating that Abdul Hameed, who is the petitioner herein is the same person for whom in the passport was issued in the name of Shanmugam Perumal. It appears that the petitioner was originally a Hindu and subsequently, embraced christiansy and thereafter, he became a Muslium. It appears that there is also some discrepancy with regard to the father's name. However, the respondent will not put these aspects against the petitioner. If the respondent is satisfied that the petitioner is one for whom the passport was originally issued, the respondent shall reissue the passport in the writ petitioner's current name. Since the petitioner's file was already closed, the petitioner can file a fresh application and the same would be disposed of on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

2. The Writ Petition is disposed of accordingly. No costs. Consequently, connected Miscellaneous Petition is closed.
