Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondents to produce the body of Manimekalai, D/o,Karunanithi, aged about 17 years before this Hon'ble Court and entrusted her custody with the petitioner.

ORDER

The petitioner herein is the father of a minor girl aged about 17 years. Since she left home without any intimation, the present Habeas Corpus Petition has been filed after lodging a complaint, alleging that the petitioner's daughter has been kidnapped by the 4th respondent herein for some ulterior motive.

2. The daughter of the petitioner is present today. She states that her mother has passed away and that her father/the petitioner herein, has remarried. She alleges that she was subjected to harassment at home and was being forced to marry the brother of her father's second wife. Therefore, she left home and staying at her friend's house in Nagapattinam. The police secured the minor girl, and she is currently put in

Annai Sathya Home, Pudukkottai. The girl has expressed her willingness to stay at the home rather than with her father and stepmother.

3. Taking note of the fact that the minor girl is only four months away from attaining majority, this Court directs the respondent police to place the minor girl at Annai Sathya Home, Pudukkottai, until she attains majority. The petitioner herein, who is the father of the minor girl, is granted visitation rights, subject to the minor girl's willingness to meet him.

4. With these observations, this Habeas Corpus Petition is disposed off.
