Writ Petition filed under Article 226 of Constitution of India, praying this Court to issue of Writ of Mandamus to direct the respondent No.4 to cancel the bar of registration made in Document No.40/2022 dated 04.07.2022 in respect of the petitioner's property in Survey No.371/2B at Ayan Reddiyapatti Village, Kariyapatti Taluk, Virudhunagar District, by considering his representation dated 24.02.2023 within the time stipulated by this Court.
ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondent No.4 to cancel the bar of registration made in Document No. 40/2022 dated 04.07.2022 in respect of the petitioner's property in Survey No.371/2B at Ayan Reddiyapatti Village, Kariyapatti Taluk, Virudhunagar District, by considering his representation dated 24.02.2023 within the time stipulated by this Court.
2. Admittedly, the petitioner has an ancestral property in Survey No. 371/2B to an extent of 1-20.17 Hectares.
3.The brief facts of the case are that several lands were purchased by PACL
company, which subsequently failed to repay its investors. Therefore, proceedings were initiated by the appropriate authorities to repay the investors. The Securities and Exchange Board of India (SEBI) has passed an order for winding up and refund the investors' money. The said order was challenged before the Securities Appellate Tribunal (SAT), Mumbai, which upheld the decision of the SEBI, vide order, dated 12.08.2015. Finally, the order was put to challenge before the Supreme Court in C.A.No.13301 of 2015 in the case of Subrata Bhattacharya Vs. Securities & Exchange Board of India, wherein the Honourable Supreme Court appointed Honourable Mr. Justice R.M.Lodha, former Chief Justice of India, for disposing of the properties purchased by the PACL.
4.The petitioner came to know that the petitioner's property is also included as the property of PACL Limited and an attachment order in Doc.No.40/2022, dated 04.07.2022 was passed by the 5th respondent without any notice or enquiry. Thereafter, the petitioner submitted a representation, dated 24.02.2023. 5.Since the matter is seized before the Honourable Mr. Justice R.M.Lodha, former Chief Justice of India, the petitioner is directed to submit a representation to the Honourable Mr. Justice R.M.Lodha, former Chief Justice of India, who in turn shall consider the petitioner's representation at the earliest.
