PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct R1 to withdraw the petitioner's complaint dated 23.12.2021 pending before the R2 and to entrust the same to any other officer not below the rank of Assistant Commissioner of Police, to investigate the complaint based on petitioner's representation dated 03.01.2022 within the time stipulated by this Hon'ble Court.

ORDER

This petition has been filed seeking direction to direct first respondent to withdraw the petitioner's complaint dated 23.12.2021 pending before the second respondent and to entrust the same to any other officer not below the rank of Assistant Commissioner of Police, to investigate the complaint based on petitioner's representation dated 03.01.2022 within the time stipulated by this Hon'ble Court.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that on the complaint dated 23.12.2021, the second respondent conducted enquiry and the same was closed on 23.03.2022 as civil in nature. https://hcservices.ecourts.gov.in/hcservices/

3.Recording the same, the Criminal Original Petition stands dismissed.
