PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 1st and 2nd respondent to implement the order passed by the 2nd Respondent and to enforce the proceedings vide Na.Ka. No. B2/3425/2023 dated 21.06.2023 and further direct the 1st respondent to take action under Revenue Recovery Act enabling the recovery amount order passed by the 2nd respondent in PG 532, 531, 523, 89, 528/2022, dated 09.03.2023. The petitioners have approached this Court seeking issuance of a Writ of Mandamus directing respondents 1 and 2 to implement the order passed by the second respondent dated 21.06.2023.
2. By the said order dated 21.06.2023, the second respondent directed the third respondent to pay the amount quantified therein towards gratuity payable to the petitioners. The petitioners contend that the said order has attained finality. However, the third respondent issued 2/5
a communication stating that the Company was facing severe financial crisis and that the gratuity dues would be settled as and when funds were mobilised. The grievance of the petitioners is that, despite the order having been passed on 21.06.2023, respondents 1 and 2 have not taken effective steps to recover the dues from respondents 3 and 4.
3. Mr. P. Subbaraj, learned Special Government Pleader, who accepts notice on behalf of respondents 1 and 2, upon instructions, submitted that the second respondent had already addressed a communication dated 21.06.2023 to the third respondent directing payment of the gratuity dues along with interest at the rate of 10% per annum, and that further action would be taken by respondents 1 and 2. The said submission is taken on record.
4. In view of the above, this Writ Petition is disposed of with a direction to the second respondent to implement the order dated 21.06.2023 and recover the gratuity dues from the third respondent within a period of twelve (12) weeks from the date of receipt of a copy of this order.

5. There shall be no order as to costs.
