.. Respondents PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971, to punish the respondents for wilful disobedience of the orders passed by this Court dated 13.09.2024 in W.P.(MD).No.21248 of 2024.

ORDER

Alleging that there is violation of the order passed in W.P.(MD). No.21248 of 2024 dated 13.09.2024, the present Contempt Petition has been filed.

2. Mr.A.Kannan, learned Additional Government Pleader appearing for the contemnors filed an affidavit of the second respondent. In paragraph 5 of the affidavit, it is stated as follows:

"5. I humbly submit that due to non-availability of funds in Vaniyangudi Panchayath, some of the roads in Muthu Nagar roads were not laid and an 04.04.2025 the subject road was jointly inspected by these Respondents along with the 1st Respondent and found that the subject road is 120 Meters length and it was found that there are several encroachments by planting banana trees, Coconut Trees, Moringa Trees and some fencings were also found in the said street. I further submit that this respondent has requested the 1st Respondent to remove such encroachments and steps are being taken to remove them. The estimate of the road has been assessed as 4.00 Lakhs and this respondent assures that the subject road will be laid within two months once the funds is received."

3. The undertaking given by the second respondent is recorded. As soon as funds are made available, they shall lay the road in terms of the undertaking given in paragraph 5.

4. Accordingly, the Contempt Petition stands closed. 28.04.2025 NCC :
