PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the respondents 2 to 4 or his men, his agent from erecting of iron poles and preventing the parking of vehicles in Survey No.200/04, Susindram Village, in front of the Kalaiarangam.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) This writ petition is filed to forbear the respondents 2 to 4 or his men, his agent from erecting iron poles and preventing parking of vehicles in Survey No.200/04, Susindram Village, in front of the Kalaiarangam.

2.Mr.P.Thilakkumar, learned Government Pleader, accepts notice for the fourth respondent, Mr.J.Ashok, learned Additional Government Pleader, accepts notice for the first respondent and Mr.R.Shankar Ganesh, learned counsel accepts notice for the second and third respondents.

3.By consent, this writ petition is taken up for final disposal at the stage of admission itself.

4.According to the writ petitioner, the second and third respondents have erected some iron poles preventing the entry of the vehicles and parking in the parking area at Survey No.200/04, Sunsindram Village in front of the Kalaiarangam. The representation submitted by the petitioner in this regard has not been considered by the authorities concerned. Hence, the petitioner has filed the present writ petition.

5.The learned Additional Government Pleader appearing for the first respondent, on instructions, submitted that the property in question belongs to the temple. He would further submit that, in order to regulate parking and manage the crowd, the temple administration has made necessary arrangements to restrict access to certain areas. It is his contention that, since such arrangements have been made in respect of the temple property for effective crowd management, the same cannot be found fault with.

6.This Court has considered the submissions made on either side and perused the materials available on record. 7.It is not in dispute that the property in question belongs to the Temple. The arrangements made by the temple administration are stated to be in the interest of regulating parking and ensuring proper crowd management and the same cannot be interfered with, unless the same are shown to be arbitrary or in violation of any statutory provision. Further, we are of the considered view that, in the present writ petition, the petitioner seeks to espouse a private interest rather than any genuine public interest. Hence, we are not inclined to entertain this writ petition. 8.Accordingly, the writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
