For Respondent : Mr.Ss.Madhavan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 522 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.3, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 304(II) of IPC & 177 of MV Act @ 304(II), 143, 269, 270, 271, 291, 505(1)(b) of IPC & 177 of MV Act r/w 109 of IPC, in Crime No.522 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The learned counsel for the petitioner would submit that earlier anticipatory bail application filed by the petitioner along with co-accused in Crl.OP(MD)No.19250 of 2021, was allowed by this Court, on 06.12.2021. But, the petitioner failed to produce sureties before the concerned Court and further time was lapsed. Hence, this present petition.

3.It is seen that this Court already granted anticipatory bail to the petitioner. Since he is not in a position to arrange sureties, he could not execute the same within a stipulated time. 4.This Court is of the considered view that when anticipatory bail already granted by this Court, the question of second anticipatory bail may not arise and the petitioner should have filed a petition for extension of time instead of filing this petition. 5.In view of the above, this Criminal Original Petition is dismissed.
