ORDER : The Court Made the following order :- The petitioner, who is arrayed as A2 in Crime No.101 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 04.04.2015 for the alleged offences punishable under sections 147, 148, 324, 307, 302 and 506(ii) of IPC and hence, seeks bail.

2.The case of the prosecution is that on 03.04.2015, the accused party and the deceased party were seeing the Adal Padal dance programme and thereafter, in a wordy quarrel, A1 attacked the deceased and A2 attacked one Selvam with aruval, while the other accused caught hold of them.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is in jail since 04.04.2015 and A3 and A6 were granted bail by this court in Crl.O.P(MD)No.9421 of 2015, dated 01.06.2015. 4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the petitioner had attacked one Selvam with Aruval and after taking treatment, he was discharged from the hospital and the petitioner is not having any previous case. 5.Considering the facts and circumstances of the case and also considering the fact that the injured has been discharged from the hospital and the period of incarceration by the petitioner, this https://hcservices.ecourts.gov.in/hcservices/

Court is inclined to grant bail to the petitioner with certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Uthamapalayam and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders. sd/- 08/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
