ORDER

This Criminal Original Petition is filed to direct the first respondent to instruct the second respondent not to harass the petitioner and his family members.

2.The petitioner states that he has purchased a land in the name of his wife, namely, Alagammai from one Periyakappan Chettiar, to the extent of 35 cents in Survey No.FS140/3 situated at Thirumayam Taluk, Panayapatti Village. The property was purchased in the year 1991 and the petitioner is in possession for the past 26 years.

3.It is stated that the son of the original owner, namely, Periyakaruppan chettiar, lodged a false complaint against the petitioner, claiming title over the property. On the basis of such https://hcservices.ecourts.gov.in/hcservices/

frivolous complaint, it is stated that the petitioner and his wife were asked to appear for enquiry for more than 20 times. It is further stated that the second respondent is compelling the petitioner to give a sum of Rs.60,000/- to the complainant without any proper reason.

4.The learned Additional Public Prosecutor, on instructions, submitted that the petition enquiry was conducted and that the same was closed, after finding that there is no truth and it is further stated that the closure report was also drawn on 24.11.2017. It is further submitted that no further enquiry is contemplated and therefore, there is no question of harassment to the petitioner.

5.Recording the submission of the learned Additional Public Prosecutor, this petition is closed.
