Respondent/Respondent/Complainant PRAYER: Criminal revision filed under Section 397 r/w 401 of Cr.P.C. against the judgment, dated 30.10.2014, made in C.A.No.3 of 2012 by the learned Sessions Judge, Kanyakumari District at Nagercoil, confirming the conviction and sentence dated 11.01.2012, made in C.C.No.85 of 2007, by the learned Judicial Magistrate No.II, Kuzhithurai.

ORDER

The petitioner is the first accused in C.C.No.85 of 2007 on the file of the learned Judicial Magistrate No.II, Kuzhithurai. The trial Court, by judgment dated 11.01.2012, convicted him under Sections 465, 468, 471 and 420 IPC and sentenced him to pay a fine of Rs.1,000/-, in default to undergo simple imprisonment for three weeks for the offence under Section 465 IPC; to undergo rigorous imprisonment for six months and to pay a fine of Rs.1,000/-, in default to undergo rigorous imprisonment for three weeks for the offence under Section 468 IPC; to pay a fine of Rs.1,000/-, in default to undergo simple imprisonment for three weeks for the offence under Section 471 IPC; and to undergo rigorous imprisonment for one year and to pay a fine of Rs.2,000/-, in default to undergo rigorous imprisonment for three weeks for the offence under Section 420 IPC. Challenging the same, the petitioner filed an appeal in C.A.No.3 of 2012 before the learned Sessions Judge, Kanyakumari, at Nagercoil. Court dismissed the appeal and confirmed the conviction and sentence imposed on him. As against the same, the petitioner has come up with this revision.

2.Today, when this revision was taken up for hearing, the learned counsel for the petitioner submitted that the petitioner is no more. No legal representative has come on record to prosecute the revision. This revision has become abated. He has also made an endorsement to that effect.

3.Recording the said statement and endorsement made by the learned counsel appearing for the petitioner, this Criminal Revision Case is dismissed as abated.
