ORDER

Seeking to quash F.I.R in Crime No.1132 of 2021 on the file of the 1st respondent, this criminal original petition is filed.

2. Since no adverse order is passed against the 2nd respondent, notice to the 2nd respondent is dispensed with.

The case of the prosecution is that on 17.10.2021 at about 05.00 a.m., while the defacto complainant and other police officials while doing patrolling duty, the petitioner had erected a flex board measuring approximately 10 feet in length and height in a public place without prior permission from the Government. Hence, F.I.R in Crime No.1132 of 2021 was registered on the file of the 1st respondent police for the offence under Section 4A (1b) of Tamil Nadu Open Places (Prevention of Disfigurement) Act, 1959.

4. The learned counsel for the petitioner submitted that the petitioner will not ever erect flex board without prior permission from the Government.

5. Heard the learned counsel on either side and carefully perused the materials available on record.

6. Considering the request of the petitioner, this Court required the petitioner to file an affidavit undertaking that he will not erect flex board without prior permission from the Government. In this regard, the petitioner had filed an affidavit dated 27.02.2026 submitting that he will not erect any flex board related to any political party without getting prior permission from the Government. Accepting the undertaking affidavit filed by the petitioner, the impugned F.I.R in Crime No.1132 of 2021 on the file of the 1st respondent is quashed. The undertaking affidavit, dated 27.02.2026 shall form part and parcel of the order. 3/5
