For Petitioner : Mr.R.Murugan For R1 : Mr.Thanga Aravindh B Government Advocate (Criminal Side) C O M M O N O R D E R These two petitions have been filed seeking to quash the charge sheet in C.C.No.12 of 2019 and C.C.No.352 of 2021 on the file of the learned Judicial Magistrate, Vilathikulam, Thoothukudi, arising out of Crime No.41 of 2017.

2. A perusal of the charge sheet reveals that the writ petitioner, being an employee of the Post Office, had misappropriated the amount without crediting the same in the savings account.

3. According to the learned counsel appearing for the petitioner, the alleged occurrence is said to have taken place within a period of one year and therefore, single charge sheet should have been filed. 3/6

4. The learned Additional Public Prosecutor appearing for the first respondent submitted that it is for the petitioner to approach the competent Court to proceed for appropriate relief.

5. This Court is of the considered opinion that the allegations in the charge sheet reflected prima facie case, but, there are no grounds to quash the charge sheet. In case, if the petitioner wishes to have a joint trial, it is for the petitioner to approach the trial Court with an appropriate application.

6. With the above said observations, these Criminal Original Petitions stand disposed of. Consequently connected Miscellaneous Petitions are closed.
