ORDER

It is an application seeking a direction to the respondent police not to interfere in the civil dispute between the petitioner and second respondent herein in respect of the property bearing Dr.No.3/139 comprised in S.F. No.219/3-l/4 situate at Tanjore Main Road, Kappakurichikattur, Thiruverambur Taluk, Trichy district.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the first respondent. 3.The learned counsel appearing for the petitioner would submit that the subject matter of litigation is pending before the Civil Court and therefore, the respondent police has no authority to ask the petitioner to vacate the shop.

4.The learned Government Advocate (Crl. Side), on instructions, would submit that there is no such harassment as alleged by the petitioner and presence of the petitioner is required for the enquiry to be conducted in connection with the complaint given by the second respondent.

5.In that event, if presence of the petitioner is required, he shall be called for enquiry by issuing summons, giving specific date, time and place.

6.This Criminal Original Petition is closed accordingly. Connected Miscellaneous Petition is closed.
