Respondents PRAYER:Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Mandamus directing the Respondents 1 to 6 to conduct an enquiry and take necessary action against the Respondent No.7 for misappropriation so as to protect the interest of Sri Mutharamman Thirukoil situated at Pitchivillai Kallakurichi Village Sathankulam Taluk, Thoothukudi District by considering the petitioner's representation dated 18.01.2024. ORDER

Heard learned counsel for the petitioner, learned Government Advocate for the respondents 1 to 6 and learned counsel for the seventh respondent.

2. The learned Government Advocate for the respondents 1 to 6 submits that the temple is not under the control of TNHR&CE Department. 2/5

However, the petitioner's representation for taking over the temple and the petitioner's request for appointment of Executive Authority to manage the temple will be decided after the decision is taken to take over the temple.

3. The learned Government Advocate for the respondents 1 to 6 further submits that this exercise will be completed by the sixth respondent within a period of three months from the date of receipt of a copy of this order.

4. Recording the same, the Court is inclined to dispose of this Writ Petition by directing the sixth respondent to dispose of the petitioner's representation on merits and in accordance with law within a period of three months from the date of receipt of this order.

5. Needless to state, the persons, who are likely to be impacted by aforesaid exercise, shall be heard, in case any adverse decision is to be taken against them, to take over the temple at request of the petitioner. 3/5
