This petition has been filed to quash the case in C.C.No.313/2011 on the file of the learned Judicial Magistrate, No.I, Tirunelveli.
2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents.
3. It is the case of the prosecution that on the complaint given by the 2nd respondent, the 1st respondent registered a case in Crime No.911 of 2009 against 233 persons under Sections 143, 285, 505 IPC and Section 74 of the MCP Act. The petitioner is one among the 233 persons. However, only 16 persons were named in the FIR leaving the others.

4. The learned counsel for the petitioner would submit that the petitioner is arrayed as 16th accused in the case and there is no prima facie case made out in favour of the prosecution case and the matter is pending trial for a period of eight years.
5. The learned Government Advocate would submit that witnesses 1 to 6 were already examined and witness No.7 is to be examined.

Though the petitioner averred in the petition that the case is pending from 2009 onwards without any progress, according to the learned Government Advocate, witnesses 1 to 6 had already been examined and the case is posted for the examination of witness No.7. When the matter is pending trial, which itself has not been disclosed before this Court, it is not fair at this stage to quash the proceedings in C.C.No.313 of 2011 on the file of the learned Judicial Magistrate, No.I, Tirunelveli. Accordingly, this petition is dismissed. Consequently, connected Miscellaneous Petitions are closed.
