ORDER
The petitioner, who is working as Assistant Executive Engineer at Villapuram Sub Division, has been transferred and posted as Assistant Executive Engineer at K.Pudhur, by the order impugned in this writ petition. According to him, the post of Assistant Executive Engineer at Villapuram Sub Division has now been filled by way of promotion. However, this promotion panel has been stayed by this Court in WP.(MD)No.29578 of 2025. 2.The case of the petitioner is that the fifth respondent, who is working as Junior Engineer Grade I has been posted in the place of this petitioner at Villapuram Sub Division and the petitioner has been transferred only to accommodate the fifth respondent in that place.
3.The learned counsel for the petitioner submits that though the panel for the promotion of the Assistant Executive Engineer has been stayed in WP.(MD)No.29578 of 2025, by circumventing the same, the fifth respondent has been promoted and posted as 3/6
an Assistant Executive Engineer and in order to accommodate the fifth respondent, the petitioner has been transferred. 4.The learned Standing Counsel appearing for the respondents submits that the fifth respondent has been promoted and transferred to the place of the petitioner. According to him, the petitioner has also been transferred in the same electricity distribution circle from Villapuram to K.Pudur. Further, the learned Standing Counsel submits that the promotion of the fifth respondent is not the subject matter of the writ petition in WP. (MD)No.29578 of 2025. According to him, she was promoted, even in the earlier panel. However, it was not effected in view of the disciplinary proceedings which was pending against her. The disciplinary proceedings has now been dropped and therefore, the fifth respondent has been posted as an Assistant Executive Engineer by promotion. According to him, the petitioner was also transferred only on his request.

5.This Court has considered the submissions made on either side and perused the records carefully.
6.The petitioner has filed this writ petition as against the order of transfer on the ground that in order to accommodate the fifth respondent in his place, he has been transferred. The petitioner has projected the case as if the respondents has granted promotion to the fifth respondent as against the interim order passed by this Court in WP.(MD)No.29578 of 2025. Since it has been clarified by the respondents that the fifth respondent is not a party to the panel, which is the subject matter of WP.(MD)No. 29578 of 2025 and it is also clarified that the petitioner has made a request for the transfer, this writ petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
