Respondent Prayer : This Criminal Revision has been filed under Section 397 r/w 401 of Criminal Procedure Code, to call for the records pertaining judgment and conviction passed by the learned Judicial Magistrate, Ambasamudram in C.C.No.317 of 2011 dated 28.01.2014 for the offence under Sections 294(b) and 324 of IPC., and sentencing the petitioner/accused to undergo one year simple imprisonment and to pay a fine of Rs.1,000/- and in appeal the IV Additional District and Sessions Judge, Tirunelveli in C.A.No.13 of 2014 dated 22.01.2015 modified the sentence by reducing that the petitioner to undergone rigorous imprisonment for three months and as far as the fine amount of Rs.1,000/- in default to undergo one month rigorous imprisonment is concerned the lower Court sentence is confirmed and set aside the same.
