ORDER

This Civil Revision Petition has been filed to strike off E.P. No. 260 of 2021 in Arbitration Case No. JJ-Bajaj Arb-7399 (HL) on the file 1/4

of the learned Principal District Judge, Nagercoil.

2. The learned counsel appearing for the revision petitioner submitted that the entire loan amount, which formed the subject matter of the dispute, has already been settled between the parties. In view of such settlement, it is submitted that the respondent has expressed its intention to withdraw the execution proceedings in E.P. No. 260 of 2021.

3. The learned counsel for the revision petitioner, however, sought time to get instructions in this regard.

4. Per contra, the learned counsel appearing for the contesting respondent submitted that the loan amount has been fully settled and that the respondent is taking steps to withdraw the execution petition. It is further submitted that in view of the settlement between the parties, nothing survives for adjudication in the present Civil Revision Petition.

5. This Court has considered the submissions made on either side. 2/4

In view of the categorical submission made by the learned counsel for the respondent that the execution petition itself is proposed to be withdrawn on account of settlement of the entire loan amount, this Court is of the view that no further adjudication is required in the present Civil Revision Petition.

7. Recording the said submission, this Civil Revision Petition is disposed of as infructuous. No costs. Consequently, the connected Miscellaneous Petition is closed.
