ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.2, apprehends arrest at the hands of the respondent police for the offences punishable under Sections 5 read with 7(3) of Tamil Nadu Lottery Regulation Act, in Crime No.

645 of 2016, on the file of the respondent police and hence, seeks anticipatory bail. 2.The case of the prosecution is that on 28.07.2016, at 15.00 hours, on information that lottery tickets banned by Tamil Nadu Government being sold, the respondent police along with the police party went near Naidu Mahal, E.B. Road at Trichy. On seeing the police party, A.2 ran away from the place of occurrence and the police party caught hold A.1 and on being search, they found 15 lottery tokens and Rs.260/- and they seized the same from him. A.1 confessed that A.2 is the owner and he and A.2 printed lottery tokens in computer and sold the same illegally for a sum of Rs.30/- each. On the basis of the said confession, the petitioner has been arrayed as A.2 in this case, for the above said offences. 3.

The case of the petitioner is that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case on the basis of the confession given by A.1.

4.The learned Government Advocate (Criminal side) submitted that the petitioner printed lottery tickets through computer which is banned in Tamil Nadu and sold the same through A.1. The accused https://hcservices.ecourts.gov.in/hcservices/

persons committed serious offence and investigation is in preliminary stage.

5.Considering the facts that the petitioner printed lottery tickets, sold the same through A.1 and collected money and the sale of lottery tickets is banned in Tamil Nadu and investigation is in preliminary stage, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly this petition is dismissed. sd/- 02/08/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
